1. Wie zijn wij?
HES Consultancy International (HCI) is verwerkingsverantwoordelijke voor persoonsgegevens die via onze websites, scans, zakelijke communicatie en ondersteunende systemen worden verwerkt.

2. Welke gegevens verwerken wij?
Wij beperken persoonsgegevens tot wat voor het zakelijke doel noodzakelijk is. Afhankelijk van uw gebruik kan het gaan om naam, zakelijke contactgegevens, bedrijf, functie, correspondentie, scan-antwoorden en beperkte website-interacties na toestemming.
Wij verwerken geen bijzondere categorieen persoonsgegevens in onze AI-workflows en vragen gebruikers om zulke informatie niet in te voeren.

De precieze grondslag hangt af van de concrete verwerking. Bij twijfel of wijziging van het doel beoordelen wij dit opnieuw.
4. Cookies en meting
Wij gebruiken geen advertentiecookies van derden. Noodzakelijke instellingen, zoals taalvoorkeur, kunnen in een cookie worden bewaard. Gedragsmeting via HCI SignalMesh start alleen volgens de op de website getoonde toestemmingskeuze.
5. SignalMesh
SignalMesh helpt zakelijke interesse en gebruikspatronen te herkennen. De website kan na de toepasselijke toestemmingskeuze interacties zoals klikken, tijd op pagina en scrolldiepte verwerken. HCI gebruikt deze signalen als ondersteuning voor menselijke beoordeling.
5a. AI-ondersteunde verwerking
HCI gebruikt zakelijke AI-diensten voor onder meer samenvatten, structureren, analyse, het opstellen van zakelijke content en ondersteuning van rapportages. Alleen gegevens die voor het betreffende doel nodig zijn mogen worden ingevoerd.
AI ondersteunt het werk van HCI; een medewerker blijft verantwoordelijk voor de beoordeling en de uiteindelijke beslissing.
Voor zakelijke AI-diensten gelden de contracten, DPA's, productinstellingen en subverwerkers van de betreffende leverancier. HCI gebruikt voor persoonsgegevens uitsluitend zakelijke diensten en instellingen die voor het beoogde doel passend zijn.
6. Verwerkers en dienstverleners
Wij verkopen persoonsgegevens niet. Voor onze bedrijfsvoering kunnen wij de volgende partijen inschakelen voor zover dat noodzakelijk is:
Hetzner Online GmbH
Hosting van HCI-platformdiensten in Duitsland.
Microsoft 365
Zakelijke e-mail en office-diensten. HCI gebruikt Microsoft 365 Copilot niet als onderdeel van deze beschreven AI-workflow.
Anthropic - Claude / Claude Cowork
Zakelijke AI-ondersteuning. Bij commerciele Claude-diensten is de Anthropic DPA onderdeel van de commerciele voorwaarden. Gebruik via derden kan onder andere voorwaarden vallen.

Zakelijke AI-diensten. Voor zakelijke OpenAI-diensten geldt de toepasselijke dienstverleningsovereenkomst en DPA. OpenAI vermeldt dat business/API-data standaard niet voor modeltraining wordt gebruikt.

Mistral AI
Zakelijke AI-diensten. Mistral AI treedt onder de DPA als verwerker op voor persoonsgegevens die namens de klant worden verwerkt. Gebruik voor modeltraining hangt mede af van product en instellingen; HCI vereist voor workflows met persoonsgegevens een passende opt-out/no-training configuratie.
Mistral AI DPAEen actuele lijst van relevante (sub)verwerkers en contractuele waarborgen wordt intern bijgehouden en op verzoek toegelicht.
6a. Doorgifte buiten de EER
Sommige leveranciers of hun subverwerkers kunnen persoonsgegevens buiten de Europese Economische Ruimte verwerken. Waar dat gebeurt, gebruikt HCI de toepasselijke doorgiftemechanismen, zoals een adequaatheidsbesluit of de Standard Contractual Clauses (SCC's), en beoordeelt HCI aanvullende waarborgen waar dat nodig is.
Wij doen daarom geen algemene belofte dat alle AI-verwerking uitsluitend binnen de EU plaatsvindt.
7. Bewaartermijnen
Wij bewaren persoonsgegevens niet langer dan nodig voor het doel waarvoor zij zijn verwerkt, rekening houdend met wettelijke bewaarplichten, contractuele verplichtingen en beveiligingsvereisten. Specifieke productretentie van AI-leveranciers kan verschillen en wordt in het verwerkingsregister vastgelegd.
8. Beveiliging
Wij gebruiken passende technische en organisatorische maatregelen, waaronder TLS, beperkte toegangsrechten, zakelijke accounts en waar beschikbaar privacy- en retentie-instellingen van onze leveranciers.
9. Uw rechten
U kunt, voor zover de AVG dat bepaalt, verzoeken om inzage, rectificatie, verwijdering, beperking, overdraagbaarheid, bezwaar en intrekking van toestemming. U kunt ook om menselijke beoordeling vragen wanneer een AI-ondersteunde verwerking een rol heeft gespeeld.

11. Wijzigingen en contact
Wij kunnen dit beleid aanpassen wanneer onze werkwijze, leveranciers of wettelijke verplichtingen wijzigen. De datum bovenaan toont de laatste inhoudelijke update.

2. What data do we process?
We limit personal data to what is necessary for the relevant business purpose. Depending on how you use our services this may include your name, business contact details, company, role, correspondence, assessment answers and limited website interactions after the applicable consent choice.
We do not put special-category personal data into our AI workflows and ask users not to provide such information.

The exact legal basis depends on the specific processing. We reassess it when the purpose changes or where the context requires it.
4. Cookies and measurement
We do not use third-party advertising cookies. Necessary preferences, such as language, may be stored in a cookie. Behaviour measurement through HCI SignalMesh starts only in accordance with the consent choice shown on the website.
5. SignalMesh
SignalMesh helps us recognise business interest and usage patterns. After the applicable consent choice, the website may process interactions such as clicks, time on page and scroll depth. HCI uses these signals to support human review.
5a. AI-assisted processing
HCI uses business AI services for activities such as summarising, structuring, analysis, drafting business content and supporting reports. Only data necessary for the relevant purpose may be submitted.
AI supports HCI's work; a human remains responsible for review and the final decision.
Business AI services are governed by the applicable contracts, DPAs, product settings and subprocessors of the relevant provider. HCI uses business services and settings appropriate to the intended purpose when personal data is involved.
6. Processors and service providers
We do not sell personal data. Where necessary for our operations, we may use the following providers:

Hosting of HCI platform services in Germany.
Microsoft 365
Business email and office services. HCI does not use Microsoft 365 Copilot as part of the AI workflow described here.
Anthropic - Claude / Claude Cowork
Business AI assistance. For commercial Claude services, Anthropic's DPA forms part of its commercial terms. Access through third parties may be governed by different terms.

Business AI services. The applicable OpenAI Services Agreement and DPA govern business services. OpenAI states that business/API data is not used for model training by default.

Mistral AI
Business AI services. Under its DPA, Mistral AI acts as processor for personal data processed on behalf of a customer. Model-training use also depends on product and settings; HCI requires an appropriate opt-out/no-training configuration for workflows involving personal data.

6a. Transfers outside the EEA
Some providers or their subprocessors may process personal data outside the European Economic Area. Where this occurs, HCI relies on applicable transfer mechanisms, such as an adequacy decision or the Standard Contractual Clauses (SCCs), and assesses supplementary safeguards where required.
We therefore do not make a blanket claim that all AI processing takes place exclusively within the EU.
7. Retention
We retain personal data no longer than necessary for the purpose for which it was processed, taking account of statutory retention duties, contractual obligations and security requirements. Product-specific retention by AI providers may differ and is recorded in our processing register.
8. Security
We apply appropriate technical and organisational measures, including TLS, limited access rights, business accounts, and available privacy and retention controls offered by our providers.
9. Your rights
Where provided by the GDPR, you may request access, correction, deletion, restriction, portability, object to processing and withdraw consent. You may also ask for human review where AI-assisted processing has played a role.

11. Changes and contact
We may update this policy when our practices, providers or legal obligations change. The date at the top shows the latest substantive update.
